AceShowbiz - Kelly Clarkson has lost her attempt to get her ex-husband evicted from their Montana property. The singer was awarded the ranch earlier this year as part of their divorce settlement and she has been trying to get her ex Brandon Blackstock to vacate the property, but a judge shut down her request.

"Kelly recently had a major legal setback in a bid to get Brandon evicted from the Montana property that the judge awarded solely to her," a source tells Us Weekly. According to the site, the judge sides with the former talent manager as he claims that he cannot afford getting his own residence due to his financial issue.

"He has been living in it and said he doesn't have the financial means to afford to purchase a residence of his own at this time, citing the unresolved financial aspect of their divorce," the source adds. "The judge sided with Brandon and ruled in his favor, the order just hasn't been formally signed off on."

Kelly addressed the court during a virtual hearing on November 11 regarding the ongoing issue over the ranch, which Brandon refused to vacate following their split. At the time, it was reported that the 44-year-old was to "testify as to the issues raised by Petitioner's Request for Order that he vacate the" ranch.

Kelly filed for divorce from Brandon in June 2020 after nearly 7 years of marriage, citing irreconcilable differences. Their divorce was finalized in August this year. They share two children, 7-year-old daughter River Rose and 5-year-old son Remington "Remy" Alexander.

The judge ruled their prenup was valid, despite Brandon's fight to get it thrown out. As the result, the "American Idol" alum gets everything she earned during their marriage, including the ranch. "The Court therefore rejects Respondent's [Brandon's] position that the Montana Ranch and other Montana properties are marital property owned 50/50 by the Parties," the documents read.

Brandon, however, seemed to be in denial with the judge's decision. In October, he told TMZ that the judge hasn't ruled on who gets the $10.4 million estate yet despite the judge's decision. The son of Reba McEntire's ex-husband Narvel Blackstock, who quit Hollywood to become a full-time ranch hand, has been living in the Montana property since their split.
