Walmart Blames Tracy Morgan for Not Wearing Seat Belt During Car Crash

The corporate retailer has responded to Tracy's lawsuit stemming from a six car accident which resulted in the death of fellow comedian James McNair.

AceShowbiz - Walmart filed on Monday, September 29 a response to Tracy Morgan's lawsuit stemming from a six car crash which involved his tour bus and a Walmart truck on the New Jersey Turnpike back in June. Walmart blamed the 45-year-old comedian for his own injuries, saying that he was not wearing seat belt during the accident.

In court papers obtained by E! Online, Walmart claimed that Tracy's injuries "were caused, in whole or in part, by plaintiffs' failure to properly wear an appropriate available seatbelt restraint device." They stated, "By failing to exercise ordinary care in making use of available seatbelts, upon information and belief, plaintiffs acted unreasonably and in disregard of plaintiffs' own best interests."

Tracy and others, who were injured in the car crash, previously filed a lawsuit against Walmart, claiming their truck driver Kevin Roper was fatigued during the accident. However in their legal response, Walmart was "unable to admit or deny" the allegation.

Brooke Buchanan, spokesperson for the company, said in a new statement, "Walmart filed its official response to the plaintiffs' lawsuit earlier today, and the company continues to stand willing to work with Mr. Morgan and the other plaintiffs to resolve this matter."

Tracy was badly injured in the accident which resulted in the death of fellow comedian James McNair. Last month, Tracy's lawyer Benedict P. Morelli gave an update on his condition, saying he still depended on a wheelchair and probably needed a few months to be able to walk without assistance.
