The set, which is Stewart's first rock release in eight years, is the star's fourth No. 1 album in his entire music career.
With Stewart taking the very top position on the album chart, last week's champ goth-pop band Evanescence's "The Open Door" slips to 2nd position with another 164,000 copies. Rapper Lloyd Banks' second set, "Rotten Apple," bows at No. 3 taking in 143,000 units. U.S. District Judge Larry Hicks has on Monday March 6th, 2006 ordered Rod Stewart to pay Harrah's Entertainment Inc., the world's largest gambling company, more than $3 million for a cancelled show in December 2000.
The ruling stems from a finding by a jury late last year that Stewart should return the $2 million the Rio Hotel and Casino paid him to appear Dec. 30, 2000. As for everybody to know, the British singer bowed out before the gig, saying he was still recovering from throat surgery for thyroid cancer several months prior to the date.

Rod Stewart Ordered to Return $2 Million Advance

"We felt it was only fair that if Mr. Stewart didn't perform the concert that he should give the money back," so said Jury foreman Stevan Jorgensen concerning the order. Kerry Garvis Wright, one of Stewart's lawyer said that the 60-year-old singer will appeal, while Steve Morris, a lawyer for the Las Vegas casino and parent company Harrah's Entertainment, said he was "delighted and relieved" by the verdict.
Stewart; to "defend my honor"

As for his side, Stewart's lawyer, Louis "Skip" Miller, told reporters his client has been willing to reschedule and has offered to perform two shows for the price of one, but is not being permitted to do so. Further, Miller explained that the thyroid surgery "took him about 10 to 12 months to get his voice back" and now "He is able and willing to do these concerts for them." According to Morris, they actually had been willing to discuss another Stewart show, but wanted the singer first to return the $2 million. When Stewart declined, the company moved forward with the lawsuit.
