Jennifer Hudson and ex David Otunga reportedly have reached a temporary agreement regarding their eight-year-old son David Otunga Junior. According to TMZ, David has been granted a primary custody of their son.

The decision is made as the Oscar winner's career requires her to travel often and spend most of her time out of the country. Jennifer is currently filming for "The Voice UK" in London as well as being committed to traveling back to Los Angeles for "The Voice".

David, in fact, has been his son's primary caregiver since birth due to the "American Idol" alum's intense schedule. The news outlet points out that despite the nasty divorce, both Jennifer and David opt to do what is best for their son.

In addition, Jennifer has voluntarily dropped the emergency protective order against her ex-fiance. According to The Blast, the 36-year-old singer/actress motioned the order vacated on Monday, November 27 in Cook County, Illinois. A judge signed off the motion.

The site reports that Jennifer decided to remove the emergency protection order as David agreed not to return to their family home.

"This wasn't a victory for David [Sr.]," says a source to PEOPLE, adding that the pair will be working together to look after their son. "Jennifer dropped the order so they could remove the matter from the courtroom and work together to do what is best for their child."

Last week, Jennifer modified her emergency order of protection against David to allow the former pro wrestler to spend Thanksgiving with David Junior. David was allowed to be with David Junior from Thursday, November 23 at 3 P.M. to Friday at 7 P.M.

Jennifer previously "requested and received a protective order against" the former pro wrestler, as her rep explained that "Jennifer's actions are solely taken in the best interest of their son." In court papers, the singer accused her ex of "increasingly aggressive, threatening and harassing behavior." In addition, Jennifer claimed that David physically abused their son, accused her of cheating with one of her producers as well as taunted her with a prop firearm which she found on the kitchen counter on September 27.

David proposed to Jennifer back in September 2008, only a year after they started dating. The pair welcomed their only son in August 2009.
