Netflix Hit With Second Lawsuit for Copyright Infringement Over 'Don't Look Up'

A second self-published author has sued the streaming giant for allegedly stealing elements from his novel for the 2021 film 'Don't Look Up' starring Leonardo DiCaprio.

AceShowbiz - Darren Hunter, of Pennsylvania, filed a lawsuit on Thursday in state court in Orlando, Florida, accusing Netflix of copyright infringement over its film "Don't Look Up". Hunter claims that the film's plot, character, and thematic elements were taken from his self-published 2015 novel, "The Million Day Forecast".

This suit follows a similar one filed by William Collier in 2021, who alleged that "Don't Look Up" was based on his 2012 novel, "Stanley's Comet". However, a federal judge dismissed that case, stating that the similarities were generic and did not warrant copyright protection.

Hunter's lawsuit alleges 34 causes of action, including copyright infringement, false advertising, and violations of Florida unfair trade practices law. It claims that "Don't Look Up" shares similarities with "The Million Day Forecast", including featuring young, determined female protagonists warning the world of an imminent catastrophe.

The lawsuit also alleges that Hunter distributed his book to individuals within the entertainment industry, including some connected to the filmmakers. However, the suit does not identify these individuals.

Netflix has not yet commented on the lawsuit. Attorney Larry Klayman, who represents Hunter, is seeking more than $3 billion in damages. In a statement, Klayman criticized the filmmakers for their "deceit and greed," which he called "a testament to the current state of some in Hollywood."

The Florida Bar is currently seeking to suspend Klayman's law license for two years based on misconduct findings that led to his suspension in Washington, D.C. Klayman is appealing this case to the Florida Supreme Court.
