AceShowbiz - Bam Margera's estranged wife Nicole Boyd has shut down claims that she's keeping him from seeing their son. In new court documents, the model clapped back at the former "Jackass" star who said that she doesn't allow him to spend time with their 5-year-old son Phoenix.
She claimed in the legal documents, obtained by TMZ on Friday, May 26, that there's no reason to move up the hearing in their legal separation case because she's abiding by the current custody orders. She added that the actor is able to spend time with their child as long as he's in California and sober.
"Mr. Margera continues to claim to be the 'injured' party because he isn't seeing Phoenix - even though he placed himself 3,000 miles away after exposing the child to abuse and drug/alcohol abuse," her attorney told the news outlet.
Her response came after Bam asked a judge to set an earlier court hearing because Nicole allegedly kept him from seeing their son. Prior to this, he also filed to dismiss Nicole's request for a legal separation as he insists they "have never been married, legally or otherwise."
"To my knowledge, Boyd has never legally changed her name in any state to 'Nicole Margera,' " he told the court. "Every driver's license or other form of identification I have seen Boyd possess bears the name 'Nicole Boyd.' "
In response to the claim, Nicole insisted that they had a wedding ceremony. "As an initial matter, it was not until just recently that Nikki had ever heard Bam's claim that they were never married," Nicole's attorney, David Glass, explained. "She was told that the wedding would occur in Iceland and that it was all taken care of."
"She had a wedding ceremony," the lawyer further elaborated. "And then returned to the U.S. and lived like a married couple with Bam for years."
Bam and Nicole had a matrimonial ceremony in Reykjavik, Iceland, on October 5, 2013. The wedding itself was featured in a since-deleted video on the MTV alum's YouTube channel. However, it's unknown if the former couple ever got a marriage license in the United States.
