Margera appeared at the county Justice Center and was interviewed at the Office of Pretrial Services, the headquarters of Chester County's probation department. After being found in violation, he was taken into custody.
Margera's probation violation stems from an arrest by Pennsylvania State Police in Fulton County on September 16. He was charged with driving under the influence of alcohol or a controlled substance and reckless driving. These charges violated the conditions of his earlier guilty plea, which included a six-month probation period and stipulations for drug and alcohol treatment.
Court records reviewed by the Mainline Media News indicate that Probation Officer Bradford Griffith has certified Margera's probation violation. Griffith has stated that Margera has failed to comply with his drug and alcohol treatment plans and remains an "overt danger" to himself and others.
Margera's attorneys, Adam Leasure, Michael T. van der Veen and William J. Brennan, have issued a statement that there are no pending charges filed against him and that they are "in the process of straightening this all out." They emphasized that Margera is presumed innocent until proven guilty.
In the June hearing related to the assault and threat charges, Margera's attorney, William J. Brennan, had stated that Margera was clean, sober and productive, but court documents indicate he has since failed to comply with drug and alcohol treatment conditions.
Margera had previously been fired from the production of "Jackass Forever" in 2021 for failing to comply with a wellness agreement he had signed. In June, he expressed that the arrest and its subsequent fallout had been a positive experience, allowing him to "clean up my life." However, his recent arrest and probation violation suggest that his recovery may be facing challenges.
