Kevin Roper, the Walmart driver responsible for a deadly accident that involved Tracy Morgan, claims that the superstore has made it impossible for him to get a fair trial.

The Walmart driver named Kevin Roper who slammed his truck into the limo occupied by Tracy Morgan and his pals wants the criminal charges against him thrown out. He is charged with death by auto and assault by auto.
According to TMZ, Roper notes in his legal documents that Walmart's admission to being responsible for the accident and the fact that he's already been convicted in the public eye would make it impossible for him to get a fair trial.
The accident took place last year, causing Morgan serious injuries and killing his friend James "Jimmy Mack" McNair. Roper who reportedly hadn't slept for more than 24 hours at the time of the fatal crash has pled not guilty.
Walmart and Morgan have reached a settlement. The comedian reportedly received $90 million from the store. He has recovered from his injuries. He recently married his girlfriend and is now preparing his comeback to comedy as a "Saturday Night Live" host on October 17.
