The 'Batman v Superman: Dawn of Justice' actor is not in a bitter custody battle with his estranged wife despite a report claiming that Jennifer wants a sole custody of their children.

Ben Affleck and Jennifer Garner are not in a "pretty nasty custody battle" despite a report published by In Touch. The website claimed that Jennifer wanted a sole custody of their three children and might use some incriminating evidence to achieve her goal.
"They're gearing up for a pretty nasty custody battle," said an insider. The source said that the "Dallas Buyers Club" actress might use Ben's issues with gambling and drinking. Besides, Ben's reported links to other women could be "Jen's trump card."
Back in 2009, when Ben was starring in and directing crime drama film "The Town", "He hit on [co-star] Blake Lively," a so-called source on the production revealed. "But she wasn't interested at all."
Despite the report, Ben and Jennifer's divorce is, in fact, far from "ugly." It's even very amicable. The two mentioned in a joint statement that they would have a "commitment to co-parenting our children." According to Gossip Cop, the estranged couple have been doing their best to achieve it, including having Affleck stay in her guest house in Atlanta, where Garner is currently filming "Miracles from Heaven". Moreover some insiders say the pair plan to share custody of their children.
Their nasty custody battle rumors aside, Ben and Jennifer are reportedly renting Brooke Shields' Pacific Palisades home, which is quite near to their home. As previously reported, their mansion is currently being renovated to better house two adults who will live separately while co-parenting their three kids.
"It's just a matter of convenience because a lot of renovations are being done on the house," a source told Us Weekly of the rental. "They are just going to rent the house for a time until the renovations are complete, not moving into it full time." Brooke's California home features five bedrooms, five-and-a-half bathrooms and some other rooms which will be convenient for Affleck and Garner to live separately.
However, the rental is not official yet as they haven't signed the contracts. "The contracts haven't been signed yet and it hasn't been worked out if [Ben] will move in or Jen, as well," the source added. "But they are figuring that out. He still plans to live on their property with Jen and the kids. This is just a temporary solution while the renovations are going on."
