A close family friend says, "Melissa does plan to sue the clinic. It's very difficult to discuss something so unpleasant with her, but she is going to launch a lawsuit."

According to the site, while New York Department of Health is still investigating Joan's death, Dr. Gwen Korovin, who was suspected of performing unplanned biopsy on Joan's vocal cords prior to her cardiac and respiratory arrest, is still seeing patients at her Upper East Side practice. Gwen reportedly charges her patients $460 for an initial consultation and she does not accept insurance.

Gwen's representative refused to make any comments on whether she's still at work.

Gwen's lawyer previously issued a statement to CNN after she was accused of taking selfie when Joan was under anesthesia in the procedure room. "Gwen S. Korovin, M.D. is a highly experienced, board certified otolaryngologist," the statement read, "She maintains privileges at one of the city's most prestigious hospitals. She is respected and admired by her peers in the medical community and she is revered by her patients."

Joan died at Mount Sinai Hospital on September 4 at the age of 81, eight days after she was rushed to hospital following the cardiac and respiratory arrest.
