Filing a lawsuit against Brian Austin Green, Delbert Shaw claims that the former 'Beverly Hills, 90210' star pummeled him after Fox yelled, 'Are you going to let him get away with that?'

AceShowbiz - Megan Fox was accused to be the instigator in an altercation between her husband and a celebrity photographer. TMZ has just brought up a report that Delbert Shaw is going to file a lawsuit in Los Angeles County Superior Court against Brian Austin Green for a brutal assault taking place in December 2011.
On what caused the incident which alleged photos were obtained by the gossip site, Shaw said he was taking pictures of Fox and Greene on the beach in front of the Four Seasons Resort in Hualalai, Hawaii. Things heated up when the 25-year-old beauty yelled to her 38-year-old husband, "Are you going to let him get away with that?" It led Greene to batter the photog to the ground.
Shaw, who is represented by attorney Sark Ohanian at law firm of Carpenter, Zuckerman & Rowley, LLP in Beverly Hills, claimed during the entire incident which left him with several injuries, Fox kept encouraging Greene. Seeking unspecified damages, the photographer added that the former "Beverly Hills, 90210" actor also threw his iPhone into the ocean.
