Lawyer Claims Eric Dane's Threesome Tape Was Shot Several Years Ago

AceShowbiz - While neither Eric Dane nor his wife Rebecca Gayheart has directly addressed the outing of their threesome tape, their lawyer Marty Singer has spoken about the matter, confirming the tape was shot several years ago and was intended to be a private one. In a statement issued Monday, August 17, Marty stated, "This is simply a private, consensual moment involving a married couple, shot several years ago, which was never intended to be seen by the public."

The lawyer furthermore stressed, "Although the participants are nude, the tape is not a 'sex tape'." He then added, "It is a private tape made for only my clients' personal use, and nobody has the right to exploit it. If anyone exploits the tape, they will be violating my clients' rights and will be exposed to significant liability."

Prior to releasing the statement, Marty Singer confirmed he will take legal action against anyone who makes public the tape, which he claims as "private and confidential". As for the third party featured in the video, former Miss Teen USA Kari Ann Peniche, she hasn't offered a single comment just yet.

On Monday, Gawker unleashed an edited version of tape featuring Eric Dane, Rebecca Gayheart, and Kari Ann Peniche all naked. The threesome appeared to be intoxicated while talking about their porn names. Despite the fact that there wasn't any sexual activity shown in the video, many Internet reports claimed the footage as sex tape.

The uncensored, 12-minute-long video of the already published tape reportedly will be unveiled on Fleshbot.com Tuesday morning, August 18.
