The Orlando-based rapper faced sentencing on May 18 following claims that he breached the terms of his release by associating with members of the 438 gang. Prosecutors initially sought a 48-month prison term, but Hotboii's attorney worked diligently to reduce this significantly.
His lawyer, Lyle Mazin, negotiated the sentence down to six months behind bars, a considerable reduction given the severity of the alleged violation. The infraction stemmed from a Facebook photo that showed Hotboii alongside two men identified by law enforcement as gang members.
According to Mazin, the photo was taken while Hotboii was getting a haircut at a private residence in Central Florida. The two men entered the home, and a picture was taken simply because that is common when a local celebrity is present. The defense also argued that the 438 designation is more of a neighborhood hashtag for Pine Hills, where Hotboii grew up, rather than an actual gang, challenging the basis for the probation violation claim.
Interestingly, the rapper's hairstyle played a key role in the judge's sentencing decision. Mazin successfully contended that Hotboii should serve jail time instead of prison partly because prison would force him to cut his signature look. The judge agreed this was a valid consideration.
Hotboii had already spent 805 days in custody following his initial arrest in July 2021 on RICO charges. He later resolved the case by pleading guilty to conspiracy to engage in racketeering. Upon his release on September 11, 2024, Hotboii immediately dropped the track "9/11 (First Day Out)," which quickly amassed over a million views online.
