The 45-year-old homeless man who punched Pauley Perrette on the face outside her Hollywood Hills home is charged with felony criminal threats and imprisonment by violence. David Merck was expected to make his first court appearance and arraigned on Monday, November 16.
Perrette was attacked on Thursday night while walking home alone in the 6000 block of Cahuenga Terrace. She recounted the horrific event, saying Merck threatened to kill her while he repeatedly beat her. "He grabbed me so forcefully, pinned my arm, punched me in the nose, forehead repeatedly telling me he was going to kill me. Then he showed me how he was going to kill me," she wrote on Twitter.

He finally let her go and she collapsed on the sidewalk while a guy walked right past her. She had to text some friends before getting help. She drew a sketch of Merck and handed it to her friend who eventually found the man. Merck was arrested at Cahuenga Boulevard and Yucca Street.
Perrette, who is a known as advocate for civil rights and the homeless, is in recovery and has been receiving support from friends and family. The passerby who ignored her that night also came to visit her to apologize. He said it was a misunderstanding and she later wrote in another tweet that he was a "good man".

Merck faces up to four years in prison if convicted. He has a long history with crime, LAPD Sgt. Bob Ward said.
