Hilary Duff's Ex Mike Comrie Is Seeking for Joint Custody for Their Son Luca

The former NHL player wants to share custody of his son, while the 'All About You' songstress wants primary custody.

AceShowbiz - Hilary Duff's estranged husband Mike Comrie has responded to her February divorce filing. Mike filed his divorce response on April 16 in a Los Angeles Superior Court. According to documents obtained by E! News, he is seeking for joint legal and physical custody of their son Luca.

While the 34-year-old former NHL player wanted to share custody of their 3-year-old son, Hilary previously stated in her divorce filing that she wanted a primary custody of Luca with Mike having the visitation rights. Mike's documents also stated that "spousal support shall be determined pursuant to the terms of the parties' Prenuptial Agreement."

Sources connected to the couple told TMZ that Hilary "is worried about Mike's parenting due to his partying ways." It was the day after Mike was reportedly "drunkenly propositioning women" at Beverly Hills' Mastro that the "Chasing the Sun" songstress filed her divorce suit.

Hilary filed for divorce from Mike a year after their separation, citing irreconcilable differences as the reason that prompted their split. She recently reflected her relationship with Mike in an interview with Cosmopolitan magazine.

"Mike and I were very in love when we met. We both really wanted to get married. I'd been working since the age of 11 or 12, so making that choice at a young age seemed right for me. Maybe it wasn't, but we spent the majority of our time together really happy," former "The Lizzie McGuire Movie" star shared, "It wasn't working well enough to stay together, but there was still a lot of love involved. It was just a slow set-in of us not being the match that we used to be. I'm lucky for the person he is and I am and how we decided to handle this."
