Kevin Costner Has No 'Legal Basis' to Kick His Estranged Wife Out of Home, Says Her Lawyer

The 'Yellowstone' actor has been asking the court to get his ex Christine Baumgartner out of their house because she violated the terms of their prenup by refusing to do so.

AceShowbiz - A lawyer of Kevin Costner's estranged wife has defended her decision not to leave their home amid divorce. Christine Baumgartner's attorney, John Rydell, said the "Yellowstone" actor has no "legal basis" to kick out his ex.

"This RFO (request for order) seeks to kick Christine and their three children out of the house that the children have lived in for their entire lives," John wrote in a court document obtained by Insider. "Although the legal basis for Kevin's request to kick his wife and children out of their home is all but nonexistent, this is still a matter of critical importance for Christine."

Kevin filed his request to kick Christine out of his house because she allegedly violated the terms of their prenup by refusing to do so. According to their prenup, Christine had 30 days to vacate the home he owns and they used to share when she filed for divorce on May 31. However, after more than 30 days, she still hasn't moved out of the house.

The 68-year-old is now asking for the court to get her out, claiming that he has given her over $1 million to find a new place. He goes on to accuse Christine of using her position as leverage to make him agree to her "various financial demands."

Kevin claimed he's already given his ex a whopping $1.2 million per his obligations under the prenup and the amount he's shelled out has grown to around $1.45 million, which he claimed is more than enough for her to find somewhere else to live. He's also willing to contribute as part of his child support obligations $30K per month for a rental house and is willing to advance another $10K for her moving costs.

Christine filed for divorce from Kevin due to his alleged infidelity. His representative, however, has denied the allegation by telling Yahoo, "Any suggestion of infidelity on the part of Mr. Costner is absolutely not true."
