Heatherton became engaged in a legal fight with her former business partner Clare Bryne last year (17) in a dispute over a planned sportswear collection the pair had been working on.

Stylist Clare initially filed a $10 million (£7.6 million) claim against the model, accusing her of abandoning the line, named RetroActive, and seeking to recoup costs associated with it, as well as future potential earnings.

Leonardo DiCaprio's one-time ex fired back by blaming Clare for ruining the range, alleging the work performed on the sample products was "inadequate and deficient in quality" and caused a delay in moving the project forward.

She demanded the return of her $25,000 (£19,000) investment, and had lawyer Stephanie Adwar represent her in the court battle.

However, according to The Blast, Adwar is now seeking to drop Erin as a client because the 29-year-old has reportedly "failed and refused to pay" her legal bills.

Adwar is allegedly owed $1,400 (£1,100), plus additional legal fees, and Heatherton is said to have informed her she cannot afford the bill and plans to file for bankruptcy.

The lawyer recently filed documents asking the judge to remove her from the case, although a decision has yet to be made.

Heatherton has yet to comment on the report.
