Her lawyer Robert Schuster said Snyder was innocent because she was not in New York when the crime occurred and that she was "erroneously charged in this matter."

In a statement to ET, Schuster said, "As of last night, we made it clear to the district attorney's office that we would not be accepting any offers or any pleas and that no pleas would be entered. The only thing we are interested in is an exoneration and an apology. At this point we are preparing for a potential trial, whether it is to be tried as a felony or a misdemeanor."

Explaining the daring outfit she wore to the court, Schuster said, "My clients are free to express themselves in any way that they choose, and I do not advise them one way or the other on availing themselves of their First Amendment privileges."

Schuster also saw no privilege coming out of Snyder's high-profile relationship with Smith in this case. "I have no reason to believe that Ms. Snyder is being treated any differently than any other defendant by the District Attorney's Office," he said. "However, any criminal prosecution has an amplified effect on a public figure due to the potential for prejudice and the certainty of increased scrutiny. To be crystal clear, I have no comment on any question regarding Mr. Smith."
