Roberto Zincone turns out to be the one who filed for divorce first after news of their split made the news last month.

AceShowbiz - Malin Akerman and Roberto Zincone's split is made official as it was learned that he has filed for divorce. The Italian drummer filed the papers in Los Angeles the day before Thanksgiving, TMZ reported.
Akerman and Zincone were married for six years when the split rumor hit the headlines in November. "It's as amicable as can be, and they want to do what's best for their son," a source told Us Weekly. However, neither Akerman nor Zincone filed for divorce yet at that time. "Honestly, Malin is not even ready to discuss it. It's a very sad time for her," the source added.
Akerman, who gave birth to Zincone's son seven months before the split news, was seen without wedding ring during a gas run. In September, she still indicated a happy marriage telling Us Weekly, "We've never had one single fight. We always talk things out."
The "Trophy Wife" actress was still praising her husband's sexy Italian accent in October. "The language of love, that was it. We used to sit with a dictionary, literally with a dictionary, and try to understand one another because he didn't speak English and I didn't speak Italian. But we understood the look," she said in an appearance on "Live! With Kelly and Michael".
Zincone plays the drum in the actress' alternative rock band The Petalstones. They got married in Sorrento, Italy in summer 2007.
