AceShowbiz - Will Smith is requesting a judge to dismiss the sexual harassment lawsuit filed against him, with his legal team labeling the case as a baseless attempt to extort money.
The lawsuit was initiated last month by violinist Brian King Joseph, who alleges that after returning to his Las Vegas hotel room, he discovered a note signed by "Stone F" stating, "Brian, I'll be back...just us."
Joseph's complaint also mentions finding various personal items in the room, including wipes, a beer bottle, a red backpack, a bottle of HIV medication bearing another person’s name, an earring, and hospital discharge papers belonging to an unknown individual.
In their motion to dismiss the suit, Will Smith's attorneys argue that Joseph admits he has no idea who "Stone F" refers to, yet has inexplicably targeted Smith and his company, Treyball Studios, in the legal action.
Additionally, the defense points out that Joseph was hired only on a per-show basis and was never promised a permanent role on the tour, contradicting Joseph’s claim that he was invited to join the band.
The filing further states that Joseph and Smith were never alone together, calling into question Joseph’s allegation that Smith was "grooming" him.
Smith's legal team is hopeful the judge will grant their motion to strike the lawsuit. They also indicate they are prepared to present witnesses who will testify that Joseph was not invited to continue with the group because he exhibited erratic behavior, was difficult to work with, and made other band members uncomfortable.
Ultimately, Will Smith's side characterizes the lawsuit as frivolous and driven by financial motives.
Attempts to reach Joseph’s lawyers for comment have not been successful so far. Meanwhile, Joseph’s attorney has stated that the outcome of a jury’s decision holds more weight than Smith's perspective on the case.
