The 'And This is Just the Intro' rapper's request to disqualify Judge David Herriford arrived after his motion for a new trial was dismissed by the latter.

AceShowbiz - Tory Lanez seemingly has run out of options to fight for his freedom. "The Color Violet" rapper previously sought to disqualify a judge in his and Megan Thee Stallion's shooting case, but his attempt was rejected.

Tory's request arrived after his motion for a new trial was dismissed by Judge David Herriford. He even claimed the judge tried "ruin his life" the day before his May 9 court appearance.

Judge David initially stated that there were no facts or circumstances requiring his disqualification in the case. "Herriford went through the seven main arguments from Lanez's lawyers and dismantled each one," Meghann Cuniff of Los Angeles Public Press wrote on Twitter last month.

"He concluded there were no errors," the journalist added. "But he also said even if he concluded each error existed, the errors didn't have a material affect on the outcome of the trial to warrant a new trial."

Now, the Appellate Court also confirmed that the judge had done nothing to warrant his removal. The Appellate Court's decision stated that the petition was denied due to a failure to demonstrate entitlement to extraordinary relief.

Tory is facing a minimum of nine years in prison after he was found guilty of shooting Megan in the foot after a 2020 party. However, prosecutors in the case reportedly want to serve 13 years in jail instead.

Meghann Cuniff shared a memorandum online that the prosecution filed on Tuesday. It read, "Words have power and the pen is oftentimes mightier than the sword. In this case, Daystar Peterson [Lanez’s legal name] used both... Not content to have hurt the victim by use of his sword (gun), he also used his pen. His online posts for nearly three years have re-traumatized the victim."

"His online reach is worldwide (millions of followers plus casual observers) and the defendant's statements embolden his followers so that they too have been complicit in re-traumatizing the victim," the memo added. "He is responsible for the effect of his words and his actions."
