AceShowbiz - A $60 million lawsuit filed against comedian Kevin Hart by his sex tape partner has been thrown out of a California court due to jurisdiction issues.

Montia Sabbag launched legal action against the "Jumanji: Welcome to the Jungle" star last year 2019, claiming he and a pal, JT Jackson, teamed up to record the 2017 liaison in a suite at the Cosmopolitan Hotel in Las Vegas without her knowledge - allegations Hart has repeatedly denied.

In February 2020, the actor moved to have the suit dismissed, claiming he hadn't been properly served the legal documents, but now a federal judge has tossed the case on a different technicality - because she filed it in the wrong venue.

However, Sabbag, who sought damages for intentional infliction of emotional distress and invasion of privacy, has been given the opportunity to refile in local civil courts as the case was dismissed without prejudice, according to documents obtained by The Blast.

Hart has maintained he had no idea about the sex tape set up, insisting he had nothing to gain from the scenario as the scandal rocked his marriage to Eniko Hart, then-pregnant with their son Kenzo, while he also claimed Jackson attempted to blackmail him over the embarrassing incident.

He and second wife Eniko managed to overcome the controversy, and are now expecting their second child together.

Hart also has two older kids from his marriage to first wife Torrei Hart.
