Johnny Depp is vacationing in Ibiza, Spain ahead his scheduled court hearing in his ongoing divorce battle from Amber Heard. The "Pirates of the Caribbean: Dead Men Tell No Tales" actor looked in good spirits as he was photographed smiling while boarding a yacht on Saturday, August 6.
Johnny is reportedly renting a villa on the island after his arrival via a private jet over the weekend. Sporting new hairstyle and mustache, the "Mortdecai" actor completed his look with a loose poncho and sunglasses.
On the same day, Amber returned to Los Angeles from London for her scheduled deposition. However, the deposition was never taken although the actress was willing to give it, according to a source.
"Although Amber was ready, willing and able to go forward with her deposition, it was not taken by Johnny's attorneys," the source tells PEOPLE, "She waited for 10 hours and at no time did Amber ever refuse to start the deposition. There was nothing preventing Johnny's counsel from commencing the deposition during that time."
According to lawyer Steve Mindel, who is not affiliated with the case, Johnny and Amber may be working on a private settlement or planning other legal maneuvers before the deposition. "I suspect that this was a great time for both sides to talk settlement, considering neither party ultimately wants to be deposed," Steve says.
Both Johnny and Amber are expected to appear in court for the domestic violence restraining order hearing scheduled for August 15 and 16.
