AceShowbiz - Troubled actor Rip Torn has been denied admission into a special probation program for first-time offenders because his charges from a drunken bank break-in in January 2010 are too serious. The "Men in Black" star, 79, is facing a string of charges, including carrying a pistol without a permit, carrying a firearm while intoxicated, first-degree criminal trespass and third-degree criminal mischief after he was found sprawled on the floor of the Litchfield Bancorp building in his hometown of Salisbury, clutching a revolver.

The actor was reportedly intoxicated and told cops he thought the building was his home. He subsequently pleaded not guilty to the offenses and checked into a treatment facility in New York to face up to his personal problems.

In July, lawyers for Torn applied to have him enrolled in an accelerated rehabilitation program which allows non-violent first-time criminals to have the charges dropped after a period of probation. But Judge James Ginocchio dismissed the motion during a hearing in Litchfield Superior Court on Wednesday, August 11, explaining Torn's prior alcohol issues disqualify him from registering for the probation program.

The case will now go to trial later this year. Torn faces a mandatory minimum sentence of one year behind bars if he is found guilty for one of the more serious gun charges.
