But Judge James Ginocchio dismissed the motion during a hearing in Litchfield Superior Court on Wednesday, August 11, explaining Torn's prior alcohol issues disqualify him from registering for the probation program.

The case will now go to trial later this year. Torn faces a mandatory minimum sentence of one year behind bars if he is found guilty for one of the more serious gun charges.
