Ed Sheeran Sued, Accused of Copying Marvin Gaye's 'Let's Get It On' on 'Thinking Out Loud'

The British singer/songwriter is sued by heirs of the composer for Gaye's 'Let's Get It On' over similarities between his hit and the 1973 soul track.

AceShowbiz - Ed Sheeran has been slapped with a lawsuit by the heirs of the composer for Marvin Gaye's "Let's Get It On". The British musician is accused of copying core elements of the late singer's 1973 track and using them in his own hit "Thinking Out Loud".

The copyright infringement lawsuit was filed by the heirs of Ed Townsend, who co-wrote the lyrics and created the musical composition of "Let's Get It On", in federal court in the Southern District of New York. The plaintiff claims that "the harmonic progressions, melodic and rhythmic elements central to 'Let's Get It On' formed the structure of Sheeran's 'Thinking Out Loud'," according to Reuters.

The lawsuit additionally says, "The Defendants copied the 'heart' of 'Let's' and repeated it continuously throughout 'Thinking'. The melodic, harmonic, and rhythmic compositions of 'Thinking' are substantially and/or strikingly similar to the drum composition of 'Let's'."

The lawsuit asks for damages to be assessed at a jury trial. A rep for Sheeran has not responded to the lawsuit.

The lawsuit comes two months after songwriters Martin Harrington and Tom Leonard sued Sheeran over his song "Photograph". The California-based musicians claimed the song was too similar to a song they wrote for U.K.'s "The X Factor" winner Matt Cardle and was released in 2012. They sought a jury trial and damages in excess of $20 million, as well as royalties.

Gaye's family last year successfully sued Robin Thicke and Pharrell Williams for unlawfully copying "Got to Give It Up" on "Blurred Lines". A jury awarded the Gaye estate $7.3 million in May 2015, which was later reduced to $5.4 million in October.
