According to sources, the fact Caitlyn braked several seconds before the impact was relevant in the D.A.'s considerations that it was tragic, but not criminal, accident.

AceShowbiz - The Los Angeles County District Attorney is currently reviewing Caitlyn Jenner's fatal car accident. Sources connected to the office tell TMZ that the initial sentiment is that the February collision was tragic but not criminal.

According to the sources, the attorneys in the Major Crimes unit which reviewed the L.A. County Sheriff's Dept. report believed it was relevant that Caitlyn braked several seconds before impact in an attempt to avoid hitting a Lexus on Pacific Coast Highway.

The D.A. should make a decision within a week. They could file misdemeanor vehicular manslaughter charges against Caitlyn because she violated the speed law by not slowing down her car quickly enough during the accident. But they don't automatically file criminal charges because a driver was inattentive.

According to the site, the D.A. didn't file criminal charges against an L.A. County Sheriff's deputy who was typing on his patrol car computer and drifted into a bike lane killing a man back in 2014. Therefore, it seems they wouldn't file charges against the "I Am Cait" star as she was not on the phone or texting during the accident.
