Michelle Rounds cannot attend the first hearing of her divorce case against Rosie because their daughter Dakota suddenly got sick.

AceShowbiz - Rosie O'Donnell and her estranged wife Michelle Rounds were scheduled for the first court hearing in their divorce case on Tuesday, May 5, but Michelle missed it. She could not attend the hearing because their daughter Dakota suddenly got sick.

Michelle's lawyer William London told New York Daily News, "The nanny delivered the child (to Rounds) Monday afternoon and she had a fever of 104.3." William said that Michelle immediately took Dakota to her pediatrician. The lawyer refused to give further details of Dakota's health except to say, "She is getting whatever she needs."

Rosie appeared at a New York City court wearing blue shirt and black pants with her lawyers. She declined to give comments when she was approached by reporters outside the courthouse. She was later seen exiting the court with security through a back entrance.

Rosie filed for divorce from Michelle in February after two years of marriage. Their split took a bitter turn after Michelle filed for full custody of Dakota in late April. Rosie's rep Cindi Berger claimed Michelle's suit was "an absurd and desperate attempt to use a child for her [Rounds'] own gain."
