Truck Driver in Tracy Morgan's Accident Asks to Delay Lawsuit

Kevin Roper, who faces criminal charges stemming from a six car crash that injured Tracy, has filed a request to delay a federal lawsuit while his criminal case proceeds in state court.

AceShowbiz - Kevin Roper, a truck driver who faces criminal charges stemming from a six car accident which injured Tracy Morgan back in June, is seeking for a case delay. Kevin's lawyer filed a request on Friday, November 14 to put Tracy's lawsuit on hold pending the outcome of his criminal case.

Attorney David Glassman contended that letting the case go forward in federal court would force Kevin to defend two actions at once, although he wasn't named in Tracy's lawsuit. David claimed that proceeding the case while the state case was pending would affect Kevin's constitutional rights "because it would provide a de facto additional forum through which the criminal prosecution could obtain evidence for use in the criminal trial against Roper."

Tracy's lawyer has not commented on the issue yet.

Tracy was badly injured in the accident which resulted in the death of comedian James McNair. He suffered from "a broken leg, a broken femur, a broken nose and several broken ribs" and spent several weeks in rehab. A month later, he sued Walmart, which owned the truck Kevin was driving, for negligence.

In late September, Walmart filed a response to Tracy's lawsuit, blaming the 45-year-old comedian for not wearing seat belt during the accident. Tracy later fired back against Walmart in a statement, saying, "I can't believe Walmart is blaming me for an accident that they caused. My friends and I were doing nothing wrong."
