The divorce trial between the '7th Heaven' alum and his wife Faye Grant was delayed just hours before it was due to start after Faye's lawyer decided to quit the case.

AceShowbiz - Stephen Collins' divorce trial, which was due to start on Wednesday, November 12, was delayed. Los Angeles Superior Court Judge Scott Gordon granted a motion filed by Faye Grant's attorney Larry Ginsberg to resign from the case just hours before the trial was scheduled to begin.

In his motion, Larry stated that he had a conflict and could no longer represent Faye. The judge denied Larry's motion was an attempt to delay the trial. The trial was postponed to allow Faye to find new attorney. Stephen and Faye are scheduled back in court on January 5 to set a new trial date.

According to TMZ, Stephen did not appear in court but blasted Faye in a separate filing, wanting $1 million which is presumably deducted from her share of the community property that is valued at around $14 million.

According to court documents obtained by PEOPLE, Stephen's attorney claimed that Faye "had been aware for 2 1/2 years that Stephen would take the position in trial that the surreptitious recording that Faye made during the parties' confidential therapy session in 2012 was unlawful and constituted a breach of her fiduciary duty to Stephen and the community."

The attorney continued, "Faye has known for over 2 1/2 years that in the event that the recording should find its way into the public arena, that would constitute a further breach of her fiduciary duty, and Stephen would seek to hold her accountable for the damages sustained as a result of her conduct in this regard."

Recently, Stephen asked a judge to terminate an order to pay his wife a $13,000 monthly spousal support because he lost all future earning power in the wake of his scandal.
