Gabriel Aubry Hits Back at Halle Berry in Court Battle

The actress wants the court to lower her child custody to around $3,800 a month, but Aubry claims he cannot get work due to injuries he sustained in a brawl with Olivier Martinez.

AceShowbiz - Legal battle between Halle Berry and Gabriel Aubry continues. The actress, who shares a daughter named Nahla with the model, is asking the court to lower her monthly support. She is supposed to pay $16,000 a month, but she asks the court to reduce it to $3,800 a month, reportedly claiming that Aubry is living off the child support.

The Canadian model now hits back at the "X-Men: Days of Future Past" actress' claims, saying that he could not get job following a brawl with her then-boyfriend Olivier Martinez. According to TMZ, Aubry said he needed six months to recover from injuries on his face following the 2012 fight and he only had 3 gigs since then.

"There is no case, no law, no logic that says a healthy, active man gets to simply live off child support that the wealthier mother earns," the "Extant" star reportedly says in her documents. Her lawyer Steve Kolodny additionally lists his personal expenses which were paid using the child support. Car expenses, his clothing, fitness, health insurance as well as furniture and electronics are mentioned in the list.

"She does feel that he is abusing the system and taking advantage of her," a source told PEOPLE. "Halle does work hard for her money, and it's not easy for her to juggle the two kids with her work schedule. It's understandable that she feels Gabriel should be able to make enough money to support Nahla."

Berry and Aubry split in 2010 after four years. The pair share equal custody of Nahla.
