Rumor has it, the estranged husband of Katy Perry will claim that he grabbed photographer Timothy Jackson's iPhone and threw it through a window because he was provoked.

AceShowbiz - Russell Brand isn't going to take his felony charge stemming from a recent phone-tossing Incident quietly. Just a few days after the "Arthur" actor was arrested and booked on one count of simple criminal damage to property for throwing a paparazzi's iPhone through a window, his New Orleans attorney Robert Glass told E! News, "We're going to fight it."

While Glass didn't specify on how Brand will fight back the accusations, it was reported that he plans to claim that he was provoked. Facing a potential fine of at least $700 for the incident, the estranged husband of Katy Perry will also argue that the damage he caused was less than $500 and he had already paid $240 for the window's reparation, TMZ reported.

Brand was accused of snatching Timothy Jackson's phone and throwing it through a glass window of a nearby law firm building on Monday, March 12. Two days afterward, a misdemeanor warrant for his arrest was issued by the New Orleans Police Department. The "Rock of Ages" star turned himself in to police custody on Thursday afternoon, and was released on $5,000 bail around an hour later.
